passport is not the only proof of your visit to US. the visit can be proved by other means as well as there is record of your visit with indian authorities as well. you have an option to file a complaint under domestic violence act and you can also file a petition for divorce and maintenance and under DV act itself, you may ask for return of your passport and other stuff.
