Legal Question in Consumer Law in India

dear sir/mam

i have a gap in case of my nokia 5800 mobile whose price is 14600rs. this is an widespread problem and if we just type with phrase of "case gap in nokia 5800" we will get about 30 to 50 sites on google discussing about it

but nokia and nokia care peoples are not accepting it as an manufacturing defect and thus not giving me replacement

so i send a legal notice to nokia last week there is no reply until now so i am planning to go in consumer court

My question is this

!) does references to internet sites discussing this problem will help me to put my case strong

2) does i have to prove that i didn't drop my mobile or the references from internet site is sufficient to prove it as the gap in all the mobile are at same place and of same size

3) does i can ask for compensation nokia for the money i have to spend for sending legal notice and for advocate who will fight case from me or nokia IN THE SAME CASE OR I HAVE TO FILE ANOTHER CASE FOR IT

4)does there is chances that i will not get compensation or only get partial compensation
