Court Staff Fraud

In a Civil Dispute of the year 1988, the Court staff colluded with the Registration Department in a act of fraud, as a result the original exhibits were returned and some dummy exhibit was submitted in its place.

Immediately after the decree in favour of the plaintiff the Court staff managed to misplace the Inward and Outward register of that particular year and of the concerned court and also tear away the inward pages containing the exhibit entry to ensure that the recordings of the orginal exhibit entry and return into that Court cannot be traced.

This fraud has come to light recently in the year 2008.

What Criminal Action can be taken against the Court Staff for such an act of fraud ?

A case can be filed against those persons under the heading of "cheating" ,"manupulation of documents", "fraud", "criminal breach of trust","cospiracy".the sections through you can take shelter for the end of justice is mentioned in Indian penal code and that is 420,120B,419,406.u have also option to bring an evidence before appealate jurisdiction.if it is proved that the evidence which u want to produce before the court is material.

If you assert that copies now in the record of the court are not the same as was originally filed, then you must be having certified copies of the documents originally produced.
