Legal Question in Insurance Law in India

I was living seperatly from my husband for last one year with my daughter. I have filed maintance case in distict court( Not a divorce case). My husband died last month. All the original LIC Bonds are in my sister-in-law possession. I am the nominee in all the policies now also. My sister-in-law has submitted an applicaton with LIC that I am divorced and my father-in-law should get the claim. My father-in-law is retired central goverment employee and getting his pension. Kindly suggest me.

Dear Madam,

As the nominee on the LIC Bonds and policies, the maturity amount payable on the death of the deceased will accrue to the nominee, in this case yourself. Your father-in-law has no locus standi in the matter and he in no way becomes eligible for the amounts payable by LIC on policies in the name of your deceased husband.

Request your sister-in-law to hand over all your husband's LIC Bonds and policies to you, to enable you to lodge a claim with LIC immediately. If she refuses, you should directly approach the LIC Office, submitting a copy of your husband's Death Certificate and extracting details of all his policies from the LIC records.

your sister in law is liable for perjury if she had stated in the court that you are divorced and as a matter of fact you are not. you may file a petition for succession of those LIC bonds of which you are the nominee.
