Can Advocate file patent application, If he is not registered patent agent/attor

I am a proprietor of my firm, can my legal representative (advocate) file patent application on behalf of my client, he is not registered patent agent/attorney. Please suggest.

No, as per the new rules a person who is not registered as a patent agent cannot file a patent. It has to be got registered only through a a person who is already a registered patent agent in India.

As per the new Govt., Circular and the rules framed thereunder, any patent application has to go thru a person who is registered as a Patent Agent in the registers of the Patent Office and a Patent Attorney can always look after the legalities of the process.

any person authorised on your behalf can file patent application.it is not necessary to get registered with patent office.
