Legal Question in Employment Law in India

A clerk employed in educational institution, in a Residential college for a period 2 years continously was terminated without any notice or compensation. Clerk disputes in labour court. The management contends that college is not an Industry within the meaning of sec 2j of Industrial disputes act 1947. what is the option for clerk?

If he was a regular emplyee then Writ in High Court.
