Deferment of Joining Date

An employer issues an appointment order, and is accepted by the appointee. The joining date is subsequently deferred couple of times. What are liabilities of the employer if it does not appoint the person? Please clarify.

Normally,the contract of employment comes into effect only upon the employee joining the service. If this employer happens to be Government which offered job to persons already in government service on deputation basis, then, until the employee gets relieved, he cannot join the new establishment. It would be fair to caution the new employee that if he[she] does not join by a particular date, the appointment order would stand withdrawn.

The employee can file awrit petition in the High Court for enforcement of the appointment letter.Please contact on pune no.020-5434569
