Legal Question in Medical Malpractice in India

Wrong prescription of a doctor

Sir- I had gone to a skin specialist for some problem. He made me have a blood test done, which revealed the TSH level in my blood was too high. He said it meant my thyroid gland was overactive and prescribed anti-thyroid pill for 21 days. But I come to know that a high TSH level means an underactive thyroid, and that he has misinterpreted the results. I want to take legal action against him and demand a compensation. Can you please tell me what is the punishment that law will give him and how much compensation I will be able to receive?

Re: Wrong prescription of a doctor

You can file a dispute before concerned District Consumer Redressal Forum for damages. You can also make a complaint to the Medical Council for negligence of the doctor. If the negligent act of doctor resulted in some injuries or harm to you, you can also initiate prosecution.
