Legal Question in Real Estate Law in India

Commercial and Residential complex together

I have a peculiar problem which is unfortunately common for many commercial enterprises in residential complexes all over Bombay.

A 5 building complex was created by the builder out of which one of the buildings was demarcated as a commercial complex, this building has a separate entrance and separate water supply etc, except for sharing a wall with 2 adjoining residential buildings there is nothing in common.

The managing committee is comprised of all residential wing members, I proposed myself in the AGM but they later scratched my name using a maximum number of members excuse, they charge us a hefty service charge but none of it goes towards the commercial wing.

We seem to be in a tricky situation here. Can we speak to the registrar for redressal?

Please advice.

Consider sub-division of the Society. It is permissible under Maharashtra Co-op Societies Act.

Re: Commercial and Residential complex together

You can file a complaint to the registrar but you have to prove this fact else they will file a case of defamation against you.
