Property sharing and transfer

Dear Sir,

My paternal grandfather and grandmother passed away in 1981 and 1997, respectively, without making a will for their property of 7 acres in Coorg, Karnataka. They have 5 children including a girl. My father who was the eldest son also passed away in April of this year. He is survived by my mother and me. My father's siblings who were until then saying that the property would be divided equally among all the 5 are now refusing to give our part in it.

The RTC is still in my grandfather's and grandmother's name.

Kindly advise on what legal action can be taken by us to get our share of the property under the Christian law?

You may need to contact a lawyer for facilitating partition of the property in accordance with law by instituting appropriate legal proceedings in the local court.

The sons & daughters of your grandfather & grandmother would be entitled to equal shares. In your case there are in all 5 sons & daughter i.e. 1/5 to each of them.

Since one of sons died, his share would go his widow, sons & daughters equally.

If there is no mutual agreement of heirs on the shares, file a partition suit in the court.
