Can my flat-mate be sued for claiming HRA benefits for my money?

Hi Sir/Madam,

I am living with my colleague in the same apartment. The lease document of the apartment is in his name. I have been giving him half of the rent+other expenses through cheques in favour of him as I am sharing the apartment with him.

But he has been claiming the HRA benefits from our company(tax evasion) on the full amount.

Can he be sued for doing so as he is paying only half the amount and claiming for the full amount?

Secondly, how can I claim for my part of HRA - which I have been giving to him through cheques monthly?

Person claiming false deductions of HRA can be prosecuted by the Income Tax Dept. As also Income Tax Dept. can impose penalities for the same. As regards your claims of HRA, consult your Chartered Accountant.
