Legal Question in Telecomm Law in India

Can they make a Leagal case on me.

One family got a bill of landline number of Rs4000. so they removed the detail bill, as there was a 5 pages of detail bill of march in that it was my mobile number of 3 pages, now they are giving me the treat that they will make a case against me for getting the bill high, now my question is can they make a case against me, as i have got only incomming, with me. i must have done 5 calls i have seen in my detail bill. As they were giving me the treat that they will go to the high officials of bsnl telecome for the same and make a charge case against me,

so will i be in legal aspects of this case or they cannot make any type of case against me , as this is the problem of bsnl and customer with bill,as they are calling me since last 4 days for the same..

requested to highlight some legal points ,and advice that what can be done and what not.

What I could understand of your problem, some third party has reveived their Bill for Rs. 4,000/- from BSNL and out of the five detailed pages attached to the Bill, your name and mobile number appears on three pages. To me, it seems a clear case of deficiency of service on part of the BSNL. In my view, the third party has no cause of action against you. It is the BSNL's mistake of mixing up and sending your bill to the third party. The third party should rather approach the BSNL to rectify the bill or follow up a legal remedy against the BSNL.

What appears from the information you provided is - that you have received calls from this party - and details of which are running in to three pages. In India, we have a system of calling party pays, that is, one who dials the no., pays, so the party who called you has to pay and not you. If at all there is a dispute it is between BSNL and BSNL's consumer, and not between you and the third party who is calling you up and threatening you. You can file a criminal complaint of harrassment against such person.
