transfer of name after demise for money to be distributed

nominee in bank states a name of one child while will states the executer has to distribute the money nominee does not agree to sign.2nd flat change of name the same problem attonery has send letter to society but all signatures are wanted which all are not willing to sign. wills states the executer has to sell and the money be distributed as per the will. unless the signature are got society is not ready to change the name. attorney letter does not help as one party not willing to sign for flat to be transferred to the executers name. how do i get the name changed and the money be distributed. both owners have expired and a will had been made which i have in my costody. in the said will it also states the money to be distributed to the heirs . but one party not willing to sign. how do i get the problem solved. two banks have given the forms to be filled. but when party is not willing to sign what is the use. had also send letter to the party to which he did not reply to the attorney. dont want to take the matter to the court and have a problem and such a long process, time consuming and waste of money too.how do i solve this problem . party not in talking terms and ready to speak up.what is the next step. please advice.

Dear sir,

you are advised to file a case for letter of administration provided under indian sucession act in respect of all the properties left by diceased including cash etc.If there is WILL then file probate.

Your best bet is to file a petition for probate of WILL in your hand. If any legal heir has objection, the court would evaluate and assess the objections and accordingly grant the probate in favour of the beneficiaries
