Legal Question in Wills and Trusts in India
My uncle has got the land property in his name in bangalore and he deceased last month without will and my aunt is the only widow of my uncle and they do not have any kids. Now the property will it be automatically transfer to my aunts name?

Dear Sir / Madam,
You may approach the Office of the District Tehsildar at Bommasandra, Huskur, Karnataka and get the title deed of the land transferred to your aunt's name. There is no automatic transfer of title since the title to the property has to vest in your aunt's name in the Municipal records to avoid any complications in future. You may also need to pay the prevailing Stamp Duty on the transfer of the title which you should check with the District Tehsildar.

she need to get legal heirs certificate and then get the name transfered in her name ...
she will have to apply for legal heir / succession certificate from the court.
