Legal Question in Credit and Debt Law in Indiana

My daughter had planned to go to college in Buffulo NY. She signed a lease with a apartment complex for students only. It turned out she didn't pass the last class she needed to get into the college. The apartment complex now wants her to pay a 10% penalty for not moving into the apartment. My question is how can she be required to pay a penalty when she was never enrolled in the school and there by she would not be allowed to live there because she wasn't a student at the university.

The successful enrollment and the contract for housing are two separate items and not necessarily dependent on each other. So, it is most likely that the penalty would be owed. If the apartment complex was owned or operated by the university, you might be able to talk to them to work out some reduction.
