Legal Question in DUI Law in Indiana

probation

my son who lives in indiana was convicted of a dui. his probation officer told him that she had the right to come to his home and arrest him if there was one beer in his house and if she smelled beer on his breath while he was in her office and if the breathlizer was above zero she could take him to jail and he would have to serve the rest of his probation (11 months) in jail. Please tell me what are his rights concerning his probation.

Unfortunetely you are going to have to ask an attorney in Indiana who is familier with Indiana Law since your son as convicted or pled guilty under Indiana law. Every state is different in its DUI laws.
