Legal Question in Family Law in Indiana

I have a 2 year old son, the father and I were never married but he signed the paternity affidavit in the hospital to allow his name to be on the birth certificate. We agreed not to have joint custody so he signed the spot indicating he denied it. We went to court to set up child support, and later parenting time. The father ended up voluntarily terminating his parenting time in court, but agreed to keep paying child support.

The father is now currently in jail, and has been for a little over a month, he isn't paying his child support (although his income is from rental properties) and has had zero contact with me or our son for 3 months.

I am planning on moving out of state in the next 6 months, do I have to file an intent to move, considering he's terminated his parenting time?
