Legal Question in Family Law in Indiana

bigamy

my husband and i have been seperated for 1yr. the divorce as of this date has not been finalized. as of the weekend of feb. 23, he has re-married. i would like to know if this is looked at as bigamy or not. if so, i would like to know what the penelties for this would be, if it is in faact a crime and what i can do about this matter. papers for divorce were filed on or about feb.1 but no final papers have been served.

Re: bigamy

If a valid marriage has not yet been disolved by a decree of dissolution of marriage granted by a court of competent jurisdiction then the "new" marriage entered into should be void or invalid. Should you have what appears to be evidence of a crime, I would suggest that you contact the county prosecutor in the appropriate jurisdiction for their review.
