Legal Question in Family Law in Indiana

Help!

mY ex husband divorced me and was final 3 yrs ago. I have MS and depended on his med insurance as my injections are 1 thous a month. Because of my disability i got NOTHING from the divorce. I was married 28 yrs.My cobra ended on Jan 1st. I am waiting to see if I am approved for medicade. I s there ANY way to hold my ex responsible for paying my med insurance? It seems so unfair. He never wanted me to work so I am not eligible for medicare. He and his new wife(an affair) are financially very well off.The drug comp. does not give any help as I have the progressive form. They only give aid to the good form of MS.I have found no lawyer that will fight for me.I am hoping some lawyer out there will see this case and be challenged by it.It has been truly a nightmare. Thank you---Sue

Re: Help!

If the judge did not find you disabled at the time of the dissolution, it is too late to do anything about that now. Your disability should not have resulted in no property distributed to you and there should have been an appeal at the time the dissolution occurred if that was the case. If you were found to be disabled, you have the right to petition the divorce court to revisit the issue of permanent maintenance from your husband. I would suggest you contact Legal Services Organization (probably the office in the largest town close to you) for assistance and/or call a local pro bono agency (for example in Indianapolis call Heartland Pro Bono or Neighborhood Christian Legal Clinic). However, three years after your dissolution may be too late to take action.
