Legal Question in Family Law in Indiana

Mother has custody of minor child. Father has parental visitation rights but lives in neighboring state (less than 30 miles from mothers house). Mother has refused visitation to father since father married another woman. Would it be considered kidnapping if father attempted to get child for supposed ice cream if possible and kept child for the night and/or weekend, against mothers choice?

Don't do this. He needs to go to court to get his rights established, not treat his child like a prize to be snatched by hook or by crook.
