If the primary custodial parent becomes incapacitated, how should the other parent legally rectify it with the courts?

Please repost and explain what you mean using the word rectify. As used in this sentence, that would imply asking the judge to fix the parent's incapacity, which is typically not with in the judge's power to do.

What are you thinking you would ask the judge to change?
