On Family Medical Leave and Terminated

My husband had a FMLA on file with his employer for me, his wife, and while on leave in December his boss called and terminated him over the phone. Can he do that?

I would need more information to ascertain whether it is likely that your husband's employer violated the law. However, on the surface, it appears that the employer may be running afoul of the FMLA requirements.
