Legal Question in Civil Litigation in Indiana

I'm in a band called "Old Dudes Rock." I know that there is another band with the same name in Michigan. I want to have T-shirts made with our name on them to sell at our gigs. How do I find out if we can do this without running into a legal problem?

Check to see if they have their name copyrighted. If it is, you can't use their name.
