Legal Question in Civil Litigation in Indiana

I have a copyright question. I have a website that I posted some photos on that were not for sale and had very little traffic. I have been reading the definition of published from the USCO and find it a little confusing.

My photos were not for sale, there was not even a pricing scheme set up. I am registering them and feel they are not published. Some people say on the net that just posting them to a website is considered publication.

I would like some information about what is considered publication by the professionals in plain English for us non lawyer types.

Using someone else's photos may be considered publishing them. Sale is not the determining factor. It's not a good idea to use someone else's property without their permission.
