Legal Question in Health Care Law in Indiana

I would like to know if I can sue the nursing home my father was in. He was there from Jan. 25, 2010 until May 24, 2010. He had a stroke and was there for rehab after a stroke. He fell 6 times in those 4 months. He ended up with a huge bedsore and a large scrape on his leg. I found ants in his room and told them about them and they sprayed while he and his roommate who also had lung problems were in the room. The last weekend he was there before we took him home he had ants again on him and he was then in a condition unable to get them off of him. We informed the supervisor and again she sent the guy in to spray while my dad and the other man was in the room only this time we were there and my sister an I removed my dad but they did not remove the other gentleman Richard who needed a lung transplant. I have information about the spary they used and it said harmful if inhaled. My dad passed from his strokes but the care and conditions at this place is unreal. My brother and I had several meetings with the supervisor, DON, and the administrator which fell on deaf ears. Just wanted to know if I could if I decided to sue this facility. Thank you. Donna

Please accept my condolences for your family's loss. Since your father did not suffer permanent injury due to their conduct, I could not suggest a lawsuit. However, you should report the facility downstate.
