Legal Question in Real Estate Law in Indiana

Abandoned vehicle

My neighbor has a broken down truck sitting partially on my property. I have been trying to have it either removed or moved over to their property. The local police says that there is no law saying that the vehicle has to be moved and I have to live with it. Do I have any legal standing concerning this vehicle and having it removed?

Re: Abandoned vehicle

I suggest that you advise your neighbor that effective immeduiately you will be charging him $25 a day for the use of your land. File a suit in about a month in small claims. My guess is that he will move the vehicle, if not, a judge will probably give you damages. At the hearing tell the judge in front of the neighbor that all you care about is having the vehicle removed, chances are there will be an agreed order requiring him to remove the vehicle. If he doesn't, you can have him held in contempt.
