Legal Question in Real Estate Law in Indiana

Changed rental agreement

Last July, my wife and I were approached by a long time "friend" ("A") of hers to move out to a farmhouse owned by "A"s brother-in-law. "A" had been laid up for several months from hip surgery. She told us she could not afford the whole rent and she knew we wanted a place in the country. She had plans to move around the first of the year so she ("A") suggested we put all the utilities in our name since she has "one foot out the door" as she put it. Now she has changed her mind and wants us out (she's got a new boyfriend). Tonight, her brother-in-law gave us written notice we have 30 days to move. The brother-in-law and I went to a neutral third party a few weeks ago where he told me that he never rented the house to us, but to "A". I have a home operated business that I made clear he knew about when we moved in. Now I will have to re-distribute advertising and phone connections. We do not feel we are obligated to move. Is there any way we can stay here until we get more time to raise the money? We spent a lot on getting things going thinking we were going to be here a while. Frankly, we don't have enough money to move.

Notice to terminate lease

In Indiana, absent an agreement to the contrary, a lease is month to month and either party can terminate upon 30 days notice. Sorry Charlie...you have to move.
