Legal Question in Real Estate Law in Indiana

How much can I sue for?

My landlord breached a written agreement with me and had my car towed. I wish to take them to small claims court regarding the matter. The amount of actual real damages (Tow bill, etc.)is about $300, however this is not the first time that the landlord has towed my vehicle. The situation also caused me an extreme amount of inconvenience, stress and the loss of my vehicle for the day. Can I add those other damages to the real damages sum?

Re: How much can I sue for?

In Indiana you may not recover damages for emotional distress unless you are physically injured-this is call ed the "impact rule".

I would ask for damages for lost wages and the reasonable rental value of the vehicle.
