Legal Question in Wills and Trusts in Indiana

My father

My father was diagnoised with cancer over a year ago and after numnerous strokes lost his battle in Oct 2008. He lived with me most of that year, I took care of him with the help of hospice and fmla from work. Dad made me his POA, and POD on our joint checking account. Dad had me cash in his IRA's and put in the checking for whatever else he may need, or in case he had to end up being put in the nursing home. He left it up to me to divide the remainder to me and my sisters. They spent there money and now I need to pay dads taxes and they refuse to help. They want more money and are threatening me to fight for more. They were no help with my dad whatsoever, they were more worried about what they could get the whole time he was sick and even now. Can they come back on me for anything? There was no Will or estate.

Re: My father

If you misused the money, or took any of it for yourself, yes, you do have some exposure. You need to sit down with the checking account and IRA information with an attorney in your areas as soon as possible to make sure you can prove all legitimate expenses. If you can not properly account for any of the money, they can sue you for 3 times the actual loss plus attorney fees.

Good luck.
