Legal Question in Wills and Trusts in Indiana

I am a remainderman with 3 siblings, my question is our parent (life estate holder and tenant) has sold timber from property and is neglecting ditching and building maintenance. He is also in a nursing home and has a POA who is collecting his moneys and will not respond to our request for financial or medical records or reports. What can we do to recover, damages and pave the way for guardianship?

Depending on what was intended in the life estate, the parent may have the right to do as he/she pleases. It all depends upon whether this was set up correctly. For purposes of determining whether you have a claim or whether a guardianship appropriate, you need to consult with either a family loan or probate litigation attorney as to the facts of your particular situation.
