Legal Question in Credit and Debt Law in Kansas

I just got a summons that a mortgage insurance company is suing my ex wife and myself for a house that was awarded to her in the divorce in 2008 and she eventually walked away from in 2009. If I have divorce papers saying that debt is her responsibility should that get me in the clear?

Probably not. Unless that company was made a party in your divorce, their contractual rights were not altered by the property division order. But, it sounds like you may be able to bring your Rx wife into this case to reimburse you for anything the Court finds that you owe. Consult directly with a civil or family law practice attorney, in your area. Do so well before the court date on your Summons. Take a copy of the Summons and the divorce papers with you.
