Legal Question in Criminal Law in Kansas

What might my sentence be

As of last Friday, I have officially been charged with a felony crime. I was fired for embezzlement on June 10th from my former employer. It has taken the county attorney until now to finally press charges. I understand that what happens now is they have requested a warrant from the district court. I have never been arrested...or even had a speeding ticket...so this is all new to me. I believe the charges will be theft/embezzlement (approz $40K). I have already made full restitution to the company...so that part is taken care of. I am waiting for them to come and arrest me. I don't really know what to expect or what the procedures are. My questions are these: Can I turn myself in instead of them coming out and arresting me? What might my sentence be for 1st offense embezzlement in Kansas? Will the fact that I have cooperated fully and have made restitution help to lessen the sentence any?

Yes, you can turn yourself in to the local county sheriff; however, it would expedite matters if you would hire counsel to represent you first. . .they can advise you step by step. Yes, it should be helpful to you that you have made restitution. Good luck.

From what you have written you should be charged with a level 7 felony and receive a prison sentence of about one year and, with no criminal record, will very likely get probation. You are going to need a good lawyer on this so you might as well get one now. The lawyer can find out the amount of the bond, line up a bondsman, surrender you to the sheriff, and get you out fairly quickly. If the bond is really high the lawyer can try to get it reduced.
