Legal Question in Discrimination Law in Kansas

I am in an age discrimination class action suit. My attorney is sticking information in the appeal defending blacks on retaliation issues and stuff. Whites have claimed to be discriminated against too. He seems to favor the blacks. This information to help blacks should not have been put into the appeal. This is not a race discrimination suit. What action can we take? This creates a conflict of interest because there are mixed races in our group.

It is impossbile to evaluate your class action case based upon a generalized description of the case, Because there is an appeal, your class either won or lost at trial. I do nto knwo which, Each makes different appellate filings proper. Therefore, I cannot deterine if including information about blacks being discriminated is improper in your appeal.

The nature of class action suits is that the class members are in the same or nearly identical standing. If you feel that your concerns about the case are not being addressed by the class counsel, you may want to opt out of the class (if you still can) and hire an attorney to birng an age discrimination action just for you.
