Legal Question in Family Law in Kansas

My boyfriend of 4 years has a 9 year old boy. Split custody and his ex wife has residentional custody and he has him every Tuesday and Wednesday as well as every other weekend. She just recently told us she is getting married and moving 5 hours away to someone she has known for six weeks and wants to take the boy with her. We have him more than our scheduled time she basically pawns him off on us among numerous other things that reflect her poor parenting. We do not want this to happen. She proposed in a mutual meeting to have him all school year except once a month and he would spend that with us. Also she said we would get all holidays (which now she throws a fit to have him on our holidays) and we would have him during summer break. The child has lived here his entire life and don't think this decision is healthy. She is constantly threatening and bad mouthing his father and I via text. We just want to know what our first step is and what we have going for our side. She orginally stated she wanted to keep it out of court and she lied we know she's seeking an attorney. Please give me some insight. We also want. the child support to be stopped.

If the mother has custody, the father's support obligation continues. Your husband likely will have to contest the proposed move, with the Court. But, first he needs to consult directly with a family law practice attorney, in his area. Don't delay. If she gave proper notice of the proposed move, your husband has only a short time to contest the move.

Good luck
