Legal Question in Family Law in Kansas

Fathers Rights

My 21 year old son's ex-girlfriend recently had a baby and when she was pregnant she told him it was his (they lived togeather for 6 months) She told him she would call him when she went into labor but she didn't. He wants to be a part of this babys life but she did not put him on the birth certifate nor will she call him. (she just had her number changed so now we can not call her) She is on wellfare and does not want my son to have anything to do with her or the baby. My son is ready and willing to put the baby on his health insurance. As a father does he have any leagal rights to this baby? Can he take her to court and get at least visitation? To this day he has not yet seen this baby and would like to help take care of it.

Re: Fathers Rights

Yes as a possible father, your son has the right to petition the court in the county where the baby reside to determine the paternity of the baby. If the court determines your son to be the father, it will set a parenting plan (visitation schedule) and child support. You need to get a lawyer and get started right away.
