Legal Question in Family Law in Kansas

In KS does a woman have to give at birth the father's last name if they are separated or divorced. She would like to give the baby her maiden name which she is also requesting her maiden name in the divorce.

Your posting is a bit confusing. A mother is not required to give her child a last name other than hers, but, if your maiden name has not yet been restored, it isn't your name, do the father can prevent the child from getting a foreign name. If you don't think that your husband is the father of your child, you don't have to give his name for the birth certificate. But, this could be used against you in your divorce case. The Court may not read quite him to pay support for a child that you say was the product of an extramarital affair. If you do not believe the father to be someone other than your husband, lying about that on the birth certificate could also be used against you. You should consult directly with a family law attorney in your area before the due date. Start with the attorney that is handling your divorce case.
