modify child custody

My ex husband and I were divorced 10 years ago. We have a 11 year old son together that has lived with me since the divorce. the ex has decided to take me to court for custody. I was re-married 5 years ago and have seperated from him 3 times since then, we have now been back together for a total of 10 months. the ex is using a ''on-again, off-Again'' relationship against me. Two years ago I got into trouble with law and am now on probation. I have not had any probation violations but it was recently extended for 12 months due to not having my fines paid off. He states in his testimony that it was extended due to my behavior, which is not true. He says my life has become ''unstable''. I take very good care of my son, and have lived in the same home for the last year. what are his chances of taking my son from me? Can I do anything about his false statements he has made about my probation? I have proof that it is not true. sorry so long, and thank you for any responses!
