can a spouse legally kick there spouse out of there own house because they want a divorce

If the first to file a divorce petition requests to temporarily keep the residence, as theirs, they can sometimes succeed in forcing the other to move out. Absent a claim of physical abuse, just saying they want a divorce is not a basis to force their spouse to move out.
