how to get written legal custody of my daughter

I have custody of my daughter my x does not provide for her in any way he does keep her over night 1 or 2 nights a week but I provide diapers food ect for the visits I want to know what I need to do in case he tries to take off with her(which he has threatened in the past)since we are not getting along to well any more. Do I have to get a lawyer? He is not stable mentally and refuses help and I am afriad he may take her or possibly harm her to get back at me.

Because your question asks how to get written custody of your daughter, I assume there has been no divorce, legal separation or paternity case. If you were not married, the best alternative is to file a paternity case and establish in writing all parenting plan provisions. Kansas law sets forth some restrictions about relocating a child's residence. You should consult an attorney to learn more.
