Legal Question in Medical Malpractice in Kansas

If someone goes in hospital for pneumonia. Dr comes in tells them they have 6 mos to live because of cancer. Then the drs give continuous morphine and ativan til the patient dies 3 days later. When family confronts dr about cancer tells them he only suspected cancer can't find it. Do we as family have a case?
