What to do if the person's condo above leaks water into yours, and they dont have insurance?

You may need to get them to pay your damages directly, or file suit. You will want to begin the process soon. You may find out that there is a third party that is liable. Your insurer may cover your damages. Then it will be up to them to get reimbursed by the liable party(s).
