Good question. As the witness for the city (or state), the officer must identify the defendant and what offense the defendant commited in this jurisdiction. A wrong date on a complaint (or citation) is usually treated as a clerical error and can be amended by the prosecution. So if you want to try this case, you have to take a gamble if this is your sole defense. If the prosecutor catches the wrong date, your defense vanishes. Even if he doesn't, you must show alibi evidence to the court that is persuasive enough to convince the court - a risky defense.

I handle many traffic citations. Feel free to email me if you want to discuss your options.
