Legal Question in Workers Comp in Kansas

If someone dies on the job..should have been under OSHA guidelines harnessed....wasn't and not even available ...until after the fall,now all are harnessed and" following " guidelines ..can company be sued for neglect,wrongful death..etc..?

The first remedy is a workers compensation death claim. Workers Compensation is a no fault system, so the cause of the death does not matter. However, in addition to workers compensation, there may be a third party remedy here. To determine that will require a thorough investigation by a competant personal injury lawyer, preferably one who is also experienced in workers compensation. If I can be of assistance, let me know.
