Legal Question in Bankruptcy in Kentucky

Financial Counselling Class When Filing KY Bankruptcy

Fiance' filed bankruptcy in Jefferson Co, KY, but has been advised he must complete a counselling class before his paperwork can be filed. Where does he take this class (?) and what is the procedure for doing so? He would like to take it in a county other than where his attorney will file the papers. Is that possible? Thank you.

Re: Financial Counselling Class When Filing KY Bankruptcy

Under the amendments to the bankruptcy code which went into effect last October, consumer debtors have to fulfill credit counseling and financial management classes. In many cases, they can be completed through some combination of on-line and telephone counseling. Your attorney should be able to tell you about the required counseling and what your options are to complete it. The counseling does not have to be done in the same county where the bankruptcy was filed, but must be done with a provider approved by the U.S. Trustee's office.
