I have custody of my 2 grandchildren for past 3 years their mother is deceased and their father is in prison for sexual assault of a minor. he is being released may 2015 is there any chance he can be near or gain custody due to his criminal history

The chances are pretty slim due to the conviction of sexual assault of a minor. However, if he attempts to do so, you should file motions to establish yourself as the de facto custody of the children and seek sole legal custody. This would put you on equal footing with the dad as though you also were the natural parent.
