Legal Question in Family Law in Kentucky

who gets the dog if we break up

Hi, long story short, about 3 months ago, I moved in with my boyfriend from New Jersey to kentucky. The relationship has turned from bad to worse, and I want to move back to new jersey. He got me a female teacup chihuahua for christmas. He did pay for her, (i've shredded the reciept), but all of her vet bills are in my name, and the dog is terrified of him, and has bonded to me. If I were to leave kentucky, and take the dog with me, would he have any legal right to her? (if it would just be a simple matter of reimbursing him the amount of the dog, i have no problem with that). Thank you so much

Re: who gets the dog if we break up

Based on the facts as you set forth, the dog was a gift to you and, therefore, your property to take with you.

Even if you two got married, the gift was prior to the marriage and the dog would be non-marital property of yours.
