Two Different States?

Husband and I have been separated since Oct 2006. We have a two months old son together. He lives in NM, I live in KY. he wants majority of custody as do I. How is custody determined across state lines. He makes more money than I do, but I have had him since birth. He is also NOT on the birth certificate, but would like to add him on.

You need to file something, even if legal separation, in Kentucky soon to insure that Kentucky has and keeps jurisdiction of this matter. There is no benefit to you or your case to assist in placing husband on the birth certificate. Beyond this, you really would be better off to go in for a consultation with a family law attorney.
