Legal Question in Wills and Trusts in Kentucky

my grandmother left her estate to her 2 sons . One of them being my dad was alive when she died in jan 2013 and he now has died in may of 2014. My uncle is just now trying to probate her will. would my mother, brother and I now inherit his portion. Her estate is in kentucky and she died in kentucky. we are in texas.

So your grandmother's estate will be divided either according to the intestate (without a will) statute of Kentucky or according to her Last Will & Testament. If her Will left a portion of her estate to your father,who survived your grandmother, then your father's estate is currently entitled to that portion. That portion will have to be divided according to your father's Will or the intestate statute where your father lived (Texas if that is where his property was located).
