Legal Question in Bankruptcy in Louisiana

divorce and mortgate

good morning! I am about 3 weeks from a fina decree of divorce. I do not live in the residence we shared/owned. There is a second mortgage on the house. I am ordered to pay this second mortgage along with just about every credit card we had. My question is this, i want to file bankruptcy, will it include credit card debt as well 2nd mortgage, etc....? Bottom line is, i want to get out from the 1st and 2nd mortgage because i dont think my wife will or can re-finance. Can I do this?

Re: divorce and mortgate

A Chapter 7 bankruptcy will relieve of the legal obligation to pay those debts, however, you may be subject to a rule for contempt in the divorce case and punished accordingly. Bankruptcy does not relieve you of any obligations which are child or spousal support ordered by a court.
