Legal Question in Business Law in Louisiana

Received a gift, now subject wants it back

I did some carpenter work for a friend, and did not charge any labor. As a gift, I was given a ladder that she told me she got through her divorce. She said it was in her way and had no use for it. Today, she called and said that she wanted it back. Does she have any legal right to get the ladder back. I was told it was a gift for doing a carpentry job. She is now saying that it belonged to her ex-husband and she should not have given it away.

Re: Received a gift, now subject wants it back

A person cannot legally sell or "give away" something that he or she does not really own to begin with--if the ladder belonged to the ex-husband, your "friend" may not have had the right to give it to you. On the other hand, maybe you should reconsider the free carpentry work and send this "friend" a bill for your labor and materials. Your friend may suddenly no longer want her ex-husband's ladder back....

Good Luck....
